Membership and Eligibility.

We offer various tiers of membership, which determine the level of access you have to the applicable site and other related services. If you have signed up using your email address through the “Register” page on the site, you are deemed a “Registered User” of Site. If you have signed up using at least your email address and provided payment information, full name, shipping address and phone number where applicable, in order to receive:

You need to be 18 years or over to become a Member. If you’re under 18 (but older than 13) you will need to be under the supervision of a parent or legal guardian who is at least 18 years of age, and this adult will be responsible for all your activities. If you are a member or a Registered User, you hereby represent and warrant that you are at least 18 years old, or between the ages of 13 and 18 and have the consent of a parent or legal guardian who is at least 18 old. Membership is not free. To access the Benefits of the Membership program you will need to have purchased a valid membership level, or otherwise be granted permission by us. When you become a Member you get a Carbon Member ID number. Your membership account immediately grants you access to many benefits, but it may also allow you to potentially buy additional items from the Membership program from time to time. Your membership is not transferable. You are solely responsible for any use of the Membership program websites that occurs in conjunction with your username and password, so keep your password secure and don’t let any other person use your username or password on your behalf. Your membership is limited to the specific site to which you registered, and your membership will automatically renew each year, until you request to terminate your membership.

Classifieds.

The site may contain “listings” or “classifieds” in which Members or Registered Users may post goods for sale or purchase, including goods that may be subject to federal, state, or local regulation, such as firearms. By posting or responding to such listings or classifieds, you hereby warrant that you are over the age of 18 years old and have the legal right to possess firearms in your community. You agree that you are solely responsible for the content of all classified ads that you post under on the site and that you will indemnify us and hold us harmless for any losses or damages to yourself or to others that may result directly or indirectly from any listings or classifieds that you post here. By using of the site, you hereby agree to not hold any of us or our owners responsible for any disputes, civil or criminal, that result between you and any of other visitor, Member or Registered User. You represent and warrant that you own or control all rights in and to the User Contributions and Submissions and have the right to grant the license granted above to us and our third party business partners and licensors and each of our and their respective affiliates, licensees, successors and assigns and that all of your User Contributions and Submissions do and will comply with these Terms of Service. You agree to indemnify us to the extent we suffer any loss or damage resulting from your breach the foregoing representation and warrant.

Monitoring and enforcement.

We do not undertake to review User Contributions or Submissions or other material before it is posted on the site, and cannot ensure prompt removal of objectionable material after it has been posted.
Accordingly, we do not represent or guarantee the truthfulness, accuracy, or reliability of any information or material posted, uploaded, input or submitted to the site by us or any users, and we do not endorse any statements, representations or opinions expressed, posted, uploaded, input or submitted to the site by users. We may utilize volunteer moderators or administrators (“Volunteer Moderators”). We have no liability or responsibility to anyone for the performance or nonperformance of the activities described in this section.

Electronic Execution.

Your electronic acceptance of this Agreement on the web site on which it is displayed shall constitute your acceptance of all terms and conditions of this Agreement and such acceptance shall have the same legal force and effect as if you had physically signed such Agreement. You agree to the admissibility of computer records and electronic evidence in any dispute under this Agreement.

Independent Contractors.

You and MyGun.pro are independent contractors. No agency relationship, partnership, joint venture, employer-employee relationship or franchisor-franchisee relationship is intended or created by this Agreement.

General Provisions.

If any provision of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision shall be enforced to the maximum extent permissible so as to put into effect the intent of this Agreement, and the remainder of this Agreement shall continue in full force and effect. The failure by either party to exercise or enforce any rights or provisions of this Agreement shall not constitute a waiver of such right or provision. This Agreement, including any other applicable terms and conditions or rules that govern your use of individual Services, which are either incorporated herein by specific reference or posted on the site from time to time, comprises the entire agreement between you and MyGun.pro and supersedes all prior representations, agreements or statements between us, written or oral, regarding the subject matter contained herein (including any prior user agreement for the site). All provisions in this Agreement regarding representations and warranties, indemnification, disclaimers and limitations on liability shall survive any termination of this Agreement. The titles and headings contained in this Agreement are used for convenience only and are not intended to affect the meaning or interpretation of this Agreement. This Agreement is binding upon and inures to the benefit of the respective successors and assigns of the parties, but you may not assign this Agreement to any person or entity without our prior written consent, and any such assignments made without consent shall be null and void. This Agreement is solely for the benefit of MyGun.pro, its affiliates, and you, and shall not be construed for the benefit of any third party.

Modifications to the Terms.
